These terms govern your use of PreGov. The part most worth reading is the section on data — because the honest answer about coverage is more useful to you than a confident one.
Draft — not yet in force
This document describes how PreGov actually works today, but it has not been reviewed by a lawyer and is not a binding agreement. Do not rely on it. It takes effect only when it carries an effective date here.
By creating an account you agree to these terms. If you are agreeing on behalf of a company, you confirm you are authorised to bind it, and "you" means that company.
Keep your credentials to yourself and tell us promptly if you think a session has been compromised. You are responsible for what happens under your account and for the people you invite into your workspace.
Accounts are per person. Sharing one set of credentials across a team is not a licence for a team; it is one account, and we may treat it as such.
PreGov aggregates public procurement records and derives analysis from them. Two things follow from that, and both matter more than any warranty language:
First, coverage is partial. Not every solicitation has a published award, and not every award publishes an amount. The live figures are on our coverage page, and the product marks a withheld figure as withheld rather than guessing at it. If a number is missing there, it is missing at the source.
Second, the data is a copy. We reproduce what an agency published, when we fetched it. An agency can correct, withdraw or re-issue a record after we read it, and there will be a lag before that reaches us.
So: do not treat PreGov as the authoritative record for a bid decision, a protest, or anything with a deadline attached. Verify against the issuing agency. We build for accuracy and tell you when we are unsure, but we are not the agency, and this service is provided as-is.
You agree not to:
Access is sold per market. Where a plan is invoiced directly rather than paid by card, the invoice terms govern the amount and the schedule, and these terms govern everything else.
Fees are stated exclusive of tax. Unless a written agreement says otherwise, payments are not refundable for a period already served; you can stop a renewal at any time and keep access until the period ends.
Anything you put into the product — pipeline notes, saved searches, proposal drafts, uploaded documents — stays yours. You grant us only the permission needed to host it, process it, and show it back to you and your workspace.
The public records themselves are not owned by either of us. Our analysis, rankings, resolved entities and derived scores are ours.
You can close your account at any time. We may suspend an account that is not paid, that is being used in breach of the acceptable-use section, or that is causing a risk to the service, and we will say which.
If we discontinue the service, we will give notice and a window to export what you put in.
To the extent the law allows: the service is provided without warranties of any kind, including any warranty that the data is complete, current or fit for a particular decision; and neither side is liable to the other for indirect or consequential loss.
Nothing here limits liability that cannot be limited by law.
We may change these terms. Material changes will be sent to the email on your account before they take effect, and continuing to use the service after that date means you accept them. If you do not, stop using the service and tell us — we will refund any period you have paid for and not used.
